1. Introductory provisions and provider
These Terms & Conditions ("Terms") are terms within the meaning of Section 1751 of Act No. 89/2012 Coll., the Czech Civil Code ("CC"), and govern the use of this web application ("App") and the electric-vehicle charging services ordered through it. The App is operated and the services are provided by 3D-lasertec s.r.o. ("Operator"); identification and contact details are given in the Legal notice. Contracts are concluded in the Czech language; other language versions of these Terms are translations only and in case of any discrepancy the Czech version prevails.
2. The service
The App lets registered drivers locate charging stations, view prices, reserve a charge point, start and stop charging sessions and pay for them. The electricity at a given station is provided by the charge point operator shown on the station page — the Operator or a third party. Charging is a service; it does not constitute supply of electricity to a customer within the meaning of Act No. 458/2000 Coll., the Czech Energy Act.
3. Conclusion of the contract (distance contract)
The framework contract for using the App is concluded by completing the registration: filling in the form, confirming your agreement with these Terms and submitting it; before submitting you can review and correct the entered data. Individual charging sessions and reservations are partial service contracts, concluded the moment they are started or confirmed in the App. The Terms are permanently available in the App; the contract is stored by the Operator in electronic form. Using means of distance communication costs you no more than your provider's basic rate; the Operator charges no extra fee for it.
4. Account and registration
You must provide accurate, current information and keep your login credentials confidential. Accounts are personal and non-transferable; you are responsible for all sessions started with your account or your charging tags. Walk-up (street) registration links your account to the operator of the station whose QR code you scanned; that operator's prices and conditions apply there.
5. Charging tags
Physical RFID cards and app-issued virtual tags identify you at charge points. Tags remain the property of their issuer, may be blocked in case of misuse or late payment, and any loss or theft must be reported to the Operator without delay.
6. Charging sessions and consent to immediate performance
A session starts once your authorization is accepted by the charge point and ends when you stop it in the App, disconnect according to the station's procedure, or the charge point ends it. Follow the instructions shown at the station and in the App and handle the cable and connector properly; remote commands depend on the charger's network connection and may be delayed or unavailable. By starting a charging session you, as a consumer, expressly request that the service be provided before the expiry of the withdrawal period, and you acknowledge that upon full performance of the service your right to withdraw from that partial contract lapses (Section 1837(a) CC).
7. Prices
The applicable price (per kWh and/or per minute and/or per session) is shown in the App before you start charging, including VAT or information about it. For walk-up drivers, prices are set by the respective station operator; a station may be visible in the App but unavailable to you until you register with its operator.
8. Payment
Depending on your account type, sessions are payable by card after each session through the secure payment page in the App, or are invoiced under your framework agreement. Card payments are processed by the payment provider GoPay; the Operator does not store your card number. Amounts due remain payable even if a payment attempt fails; unpaid sessions may lead to blocking of further charging.
9. Reservations
Where offered, you may reserve a charge point for the limited time shown in the App. A reservation expires automatically at the displayed time or when you start charging, and can be cancelled in the App. Station operators may restrict or refuse reservations.
10. Consumer's right of withdrawal
If you are a consumer, you may withdraw from the framework contract without giving reasons within 14 days of its conclusion (Section 1829 CC) by an unambiguous statement sent to the contact e-mail given in the Legal notice; you may use the model withdrawal form under Czech Government Regulation No. 363/2013 Coll. Withdrawal does not affect charging sessions already fully performed (see Section 6); sessions provided before withdrawal remain payable under Sections 7 and 8. Beyond that, you may close your account at any time free of charge — the framework contract is concluded for an indefinite period and you may terminate it at any time.
11. Complaints (rights from defective performance)
Rights from defective performance are governed by Section 1914 et seq. CC and Act No. 634/1992 Coll., on Consumer Protection. Report service defects (e.g. a failed or incorrectly billed session) without undue delay to the contact e-mail in the Legal notice; we will confirm receipt of your complaint. Complaints, including remedying the defect, are settled within 30 days of filing at the latest, unless a longer period is agreed; if this period expires in vain you may withdraw from the partial contract or claim a reasonable discount.
12. Availability
The App and the charging network are provided without any guarantee of uninterrupted availability. Stations may be occupied, offline, under maintenance or decommissioned, and displayed statuses or prices may be temporarily out of date. Your rights under Section 11 remain unaffected.
13. Your obligations
Use stations and cables with due care, only for charging suitable electric vehicles, and observe the rules of the site (parking, time limits). Do not tamper with the equipment. You are liable for damage caused by improper use under general law.
14. Liability
The Operator is liable for harm in accordance with generally binding law. Nothing in these Terms excludes or limits liability for harm caused to a person's natural rights, intentionally or by gross negligence (Section 2898 CC), nor consumer rights arising from mandatory statutory provisions. The Operator is not liable for the availability of stations operated by third parties.
15. Out-of-court dispute resolution and supervision
The body competent for out-of-court resolution of consumer disputes arising from these contracts is the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) under Section 20d et seq. of the Consumer Protection Act; you may also use the EU online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr. Consumer-protection supervision is exercised by the Czech Trade Inspection Authority; personal-data supervision by the Czech Office for Personal Data Protection.
16. Data protection
Personal data is processed to operate the service (account, charging sessions, billing) in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll. Details and the contact for exercising your rights can be found in the Privacy Policy available in the App.
17. Changes to these Terms
The Operator may unilaterally amend these Terms to a reasonable extent (Section 1752 CC). Changes will be announced in the App at least 14 days before they take effect. You may reject a change and, for that reason, terminate the framework contract free of charge with immediate effect before the change takes effect; otherwise you are deemed to have accepted it.
18. Final provisions
These Terms and the contracts concluded under them are governed by the law of the Czech Republic. For consumers, court jurisdiction follows the general procedural rules; if the user is an entrepreneur acting within their business, the courts at the Operator's seat have jurisdiction. Should individual provisions be or become invalid, the remaining provisions stay effective.
